1. TERMS OF USE AND WEBSITE PURPOSE

 

The purpose of these Terms of Use ("Terms") is to define the terms and conditions under which the website https://edflex.com/ (the "Website") is made available by Edflex (the "Publisher", "we" or “us”) to  users (the " User" or "you"). Use of the Website implies your acceptance without exemption of these Terms and your compliance with any applicable legal and regulatory requirements. The Publisher may change these Terms from time to time, and you are therefore invited to read them regularly. The Website is provided for informational purposes about Edflex activities.

 

2. WEBSITE ACCESS

 

The Website is available for a personal and a professional use and is reserved to users who are 18 years of age or older. You are responsible for your own login credentials. Thus, any individual who access the Website is deemed to be the person for whom the credentials were issued by the Publisher.

You acknowledge that you have the skills, equipment and means needed to use the Website.

The Website is accessible on a permanent basis, however, the Publisher may, at its sole discretion, suspend, discontinue or prohibit access to all or any part of the Website. The publisher does not warrant that the Website will be available uninterruptedly. The Publisher cannot be held liable for any reason whatsoever.

The Website services can be accessed for free.

 

5. INTELLECTUAL PROPERTY AND INFRINGEMENT

The Publisher is the owner of the intellectual property rights and holds the usage rights relating to all the elements available on the Website, in particular to any text, images, graphics, logos, videos, icons and/or sounds. The Publisher grants the User a personal, non-transferable and non-exclusive use only right, for his or her own needs only and strictly limited to the purpose of the Website.

The Publisher is subject to  an obligation of means and is only liable for direct damages.

  • Website’s content

The Website, its content and any information presented through the Website are provided for information purposes only on an “as is” and “as available” basis, without any warranties of any kind, either express or implied, and may be changed by the Publisher at any time.

If any provision of these Terms is invalid, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions will continue in full force and effect.

All photos shown on the Website are non-contractual pictures.

  • Force majeure

The Publisher shall not be held liable in the event of force majeure as defined in Article 1218 of the French Civil Code or in case of events beyond its control.

  • Security

The Publisher shall not be held liable for any loss or damage caused to your computer equipment and data or for any intrusion by third parties despite the security measures in place.

Our goal is to provide a service that ensures the best possible availability. The Host ensures the continuity of its service 24 hours a day, every day of the year. However, it reserves the right to interrupt the hosting service for the shortest possible period of time, in particular for the purposes of maintenance, improvement of its infrastructures, failure of its infrastructures or if the Services generate traffic deemed abnormal.

The Publisher and the Host cannot be held responsible in the event of malfunctioning of the Internet network, telephone lines or computer and telephone equipment, particularly in the event of network congestion preventing access to the server.

  • Equipment

The Publisher shall not be held responsible for any material damage related to the use of the Website. Furthermore, the User undertakes to access the Website using recent, virus-free equipment and with a last-generation updated browser.

  • Links to other websites

When hypertext links to websites published and/or managed by third parties are present on the Website, you acknowledge that the Publisher does not assume any responsibility for the provision of the links insofar as no control is exercised over these external resources. The Publisher cannot be held responsible for the content or operation of the third-party websites. Any creation of links redirecting to the Website and more broadly the use of any element of the Website is subject to the prior written authorisation of the Publisher, which may be revoked at any time at its sole discretion.

As part of the Website services, the Publisher may process personal data of users, as communicated in any Website form or resulting from their use of the Website, in accordance with the applicable regulations.

8. SECURITY INCIDENT NOTIFICATION

Despite our best efforts, no information transmission method over the Internet and/or electronic storage method is completely secure. We therefore cannot guarantee absolute security. If we become aware of a security breach, we will notify affected users so that they can take appropriate actions. Our incident reporting procedures take into consideration our legal obligations, whether at national or regional level.

 

9. GOVERNING LAW AND JURISDICTION

ANY DISPUTE RELATING TO THE USE OF THE WEBSITE SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH FRENCH LAW. EXCEPT IN CASES WHERE THE LAW DOES NOT ALLOW IT, EXCLUSIVE JURISDICTION IS GIVEN TO THE COMPETENT COURTS OF PARIS.
